TERMS AND CONDITIONS
1. Introduction
These Terms and Conditions form part of an agreement between Nature Carer Environmental Solutions (“we”, “us”, “our”) and the customer named in the quote or contract (“you”, “your”).
2. Acceptance
This agreement commences when you accept our offer by:
- • Paying a deposit
- • Accepting via phone or email
- • Signing and returning the quote or agreement
You agree to pay any required deposit at the time of acceptance.
3. Customer Warranties
You warrant that you:
a) Are at least 18 years of age;
b) Are the property owner or authorised by the property owner;
c) Have read and accepted these Terms and Conditions.
4. Definitions
• System means the energy system specified in the quote (including solar, heating/cooling, or energy-efficient upgrades)
• Installation Address means the site where the system will be installed
• Incentives means any government rebates, certificates, or financial incentives
• Quote means the proposal provided to you outlining system details and pricing
5. Our Obligations
We will:
a) Supply and install the system as outlined in the quote;
b) Engage appropriately licensed and qualified installers;
c) Ensure installation complies with applicable standards and regulations.
6. Your Obligations
You agree to:
a) Pay all amounts due as specified in the agreement;
b) Provide access to the installation site;
c) Provide accurate and complete information;
d) Assign any applicable government incentives (such as STCs or VEU benefits) where included in the quoted price.
Failure to meet obligations may result in delays or additional costs.
7. Pricing and Variations
a) Pricing is based on initial site information and eligibility assumptions.
b) We may adjust pricing if:
• Site conditions differ from initial information
• Additional work is required
• Government incentives change
c) Any changes will require your approval before proceeding.
8. Government Incentives
a) Pricing may include government incentives or rebates.
b) If incentives are reduced, unavailable, or not approved:
• You agree to pay the difference
c) Eligibility is not guaranteed until fully assessed and approved.
9. Payments
a) Payment methods may include bank transfer, credit card, or other agreed methods.
b) Full payment is required in accordance with the agreement, typically prior to or upon installation.
c) Late payments may incur:
• Interest charges
• Administrative and recovery costs
10. Installation and Delivery
a) We will make reasonable efforts to meet installation timeframes.
b) You must provide access for inspection, delivery, and installation.
c) Installation dates may change due to:
• Weather conditions
• Supply delays
• Site readiness
11. Target Date
a) Installation dates are estimates only.
b) Delays may occur due to factors outside our control.
c) If installation is significantly delayed, you may have the right to cancel and receive a refund.
12. Termination
a) We may terminate the agreement if regulatory or legislative changes prevent installation.
b) Either party may terminate if pricing changes are not agreed.
c) Cooling-off rights apply in accordance with applicable law.
13. Refunds
You may be entitled to a refund if:
a) The final system differs significantly from the agreed quote and is not accepted by you;
b) Required approvals cannot be obtained;
c) Installation cannot be completed within a reasonable timeframe;
d) Equipment is unavailable and no suitable alternative is accepted.
14. Warranties
a) Our goods and services come with guarantees under the Australian Consumer Law.
b) Manufacturer warranties apply to supplied products.
c) We provide workmanship warranties in accordance with industry standards.
d) Warranties do not cover damage caused by:
• Misuse or neglect
• External events (weather, power surges, etc.)
• Unauthorised modifications
15. Limitation of Liability
To the extent permitted by law:
• We are not liable for indirect or consequential losses
• Liability is limited to resupply or repair of services
Nothing excludes rights under the Australian Consumer Law.
16. Ownership and Risk
a) Ownership transfers once full payment is received and installation is complete.
b) If payment is not made, we reserve the right to recover goods where legally permitted.
17. Complaints Handling
We maintain a formal complaints process:
• Complaints acknowledged within 5 business days
• Resolution targeted within 20 business days
Unresolved complaints may be escalated externally.
18. NETCC Commitment
We are committed to complying with the New Energy Tech Consumer Code (NETCC) and maintaining high standards of consumer protection and service delivery.
19. Entire Agreement
This agreement constitutes the full agreement between the parties.
Any variations must be agreed in writing.
20. Governing Law
This agreement is governed by the laws of Victoria, Australia.
